Ops Check User License Agreement (ULA) Effective Date: September 12, 2026 This User License Agreement ("Agreement") is a binding agreement between you ("User," "you," or "your") and the owner/operator of Ops Check ("Ops Check," "we," "us," or "our"). By creating an account, accessing, browsing, subscribing to, or otherwise using Ops Check, you agree to be bound by this Agreement. If you do not agree to this Agreement, you must not use Ops Check. 1. License Grant Ops Check grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Ops Check platform and its content solely for your personal, non-commercial study and educational purposes, subject to this Agreement. This license does not grant you any ownership rights in Ops Check, its software, content, branding, study materials, or underlying systems. 2. Eligibility By using Ops Check, you represent and warrant that: • you are at least 18 years old, or you have the consent of a parent or legal guardian; • you are legally permitted to enter into this Agreement; • your use of Ops Check will comply with all applicable laws, rules, and regulations. If you are using Ops Check on behalf of another person or entity, you represent that you have authority to bind them to this Agreement. 3. Accounts and Account Security You may be required to create an account to access certain features of Ops Check. You are responsible for: • maintaining the confidentiality of your login credentials; • all activity that occurs under your account; • ensuring that your account information is accurate and current. You agree to notify Ops Check promptly if you suspect unauthorized use of your account or any other security incident. We reserve the right to suspend or terminate accounts that appear compromised, fraudulent, abusive, or in violation of this Agreement. 4. Acceptable Use You agree not to, and not to assist others to: • use Ops Check for any unlawful purpose or in violation of any applicable law or regulation; • copy, scrape, harvest, download, reproduce, republish, redistribute, or bulk extract Ops Check content except as expressly permitted by this Agreement; • reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, data structures, or platform logic, except to the extent such restriction is prohibited by law; • resell, sublicense, share, lease, distribute, or otherwise provide access to Ops Check content or services to third parties; • interfere with, disrupt, damage, or compromise the functionality, security, or integrity of the platform; • upload malicious code, bots, scripts, viruses, or harmful content; • impersonate another person, misrepresent your identity, or falsely claim affiliation with any person or organization; • misuse any community, DME, ranking, review, or reporting feature in bad faith. 5. Intellectual Property Ops Check, including its platform design, branding, logos, layout, software, databases, graphics, study tools, compilations, and content selection and arrangement, is owned by Ops Check and/or its licensors and is protected by applicable intellectual property laws. Except for the limited license expressly granted in this Agreement, no right, title, or interest in or to Ops Check is transferred to you. You may not use Ops Check trademarks, logos, or branding without prior written permission. 6. Study Materials and Educational Content Ops Check provides educational materials, including but not limited to: • multiple-choice questions; • oral and practical prompts; • explanations; • flashcard content; • ACS code study tools; • AI-assisted study features; • analytics and performance summaries. These materials are provided solely as study aids. You acknowledge and agree that: • Ops Check is an independent educational platform; • Ops Check is not affiliated with, endorsed by, sponsored by, or approved by the FAA or any government agency; • study materials may be changed, updated, corrected, expanded, or removed at any time; • you remain solely responsible for verifying information against current official FAA publications, regulations, approved technical data, and instructor or examiner guidance where applicable. 7. AI-Assisted Content and Platform Development You acknowledge that artificial intelligence tools played a significant role in assisting with the creation, organization, refinement, and expansion of portions of the Ops Check website, its study materials, explanations, prompts, and certain platform features. Because AI-assisted systems may produce errors, omissions, wording issues, inconsistencies, or outdated interpretations, you acknowledge and agree that: • Ops Check content may contain mistakes; • AI-generated or AI-assisted content may not always be complete, current, or accurate; • you must independently verify important study or technical information against official FAA references and current standards. The use of AI as part of the development or content-generation process does not create any guarantee of correctness, completeness, or exam outcome. 8. Similarity to Other Materials Ops Check does not claim to reproduce or represent any proprietary third-party question bank, oral prep product, or exam-prep publication. You acknowledge and agree that: • any similarity between Ops Check multiple-choice questions, answer explanations, O&P prompts, or other educational materials and any third-party publication, study guide, test-prep product, or educational resource is purely coincidental, and/or • such similarity may arise from the fact that many aviation maintenance study resources necessarily address the same underlying FAA subject matter, concepts, terminology, and technical references, and/or • there are only limited ways to accurately express certain technical ideas, maintenance concepts, definitions, or FAA-related study topics. Any overlap in subject matter, phrasing, or explanation style is not intended to suggest copying, endorsement, affiliation, or association with any third-party publication. 9. No Guarantee of Passing or Certification Outcome Ops Check is a study aid only. Use of Ops Check, including repeated use, high scores, streaks, AI DME practice, review tools, or completion of study sessions, does not guarantee that you will pass: • any FAA written examination; • any oral examination; • any practical examination; • any DME evaluation; • any certification process or training program. Your study habits, preparation, retention, instruction, testing conditions, judgment, and performance are solely your responsibility. Successful exam performance depends on the individual user, not on any promise by Ops Check. 10. Payments, Subscriptions, Billing, and Pricing If Ops Check offers paid plans, subscriptions, or premium features: • pricing, billing intervals, and plan details will be displayed at the time of purchase; • subscriptions may renew automatically unless canceled in accordance with the displayed billing terms; • payment processing is handled by third-party payment providers, and Ops Check does not store full payment card details; • access to premium features may depend on successful payment processing. You acknowledge and agree that: • the price of an Ops Check subscription may change at any time in the future; • future pricing changes will apply prospectively and not retroactively unless otherwise disclosed; • continued use of a paid plan after a pricing change takes effect may constitute acceptance of the updated price, subject to applicable billing disclosures and cancellation rights. Refunds, if any, are governed by the refund policy shown at purchase or elsewhere on the platform. 11. User Content If you submit content to Ops Check, including notes, responses, flags, reports, reviews, ratings, or other materials, you grant Ops Check a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, process, analyze, adapt, and use that content for the purpose of operating, improving, moderating, and supporting the platform. You represent and warrant that: • you have the right to submit such content; • your content does not violate the law or the rights of others; • your content is not knowingly false, abusive, defamatory, or misleading. We reserve the right, but not the obligation, to remove, edit, hide, or moderate user content at our discretion. 12. DME Information and Removal Requests Ops Check may display information about Designated Mechanic Examiners ("DMEs"), including publicly available contact or directory information, for educational, informational, or user-reference purposes. If a DME wishes to request removal of their information from Ops Check, they may do so by sending an email request to Ops Check support. Ops Check reserves the right to review and honor such requests in its discretion, including by removing, hiding, or limiting the visibility of such information. Ops Check does not guarantee that third-party or user-submitted information about any DME is complete, current, or error-free. 13. Service Availability and Changes Ops Check may add, remove, suspend, modify, or discontinue any feature, content set, pricing model, AI tool, review feature, sync feature, leaderboard, or other aspect of the platform at any time, with or without notice. We do not guarantee that the service will always be available, uninterrupted, secure, or error-free. 14. No Professional, Legal, or Maintenance Advice Ops Check is an educational platform only. It does not provide legal advice, regulatory advice, maintenance authorization, airworthiness determinations, or professional certification advice. Ops Check is not a substitute for: • approved technical data; • aircraft maintenance manuals; • FAA regulations; • training from instructors or approved programs; • examiner or designee guidance; • professional judgment. Do not use Ops Check as the sole basis for performing maintenance, approving work, making airworthiness decisions, or interpreting legal or regulatory obligations. 15. Disclaimer of Warranties To the fullest extent permitted by law, Ops Check is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. Ops Check disclaims, to the maximum extent permitted by law, all warranties including but not limited to: • merchantability; • fitness for a particular purpose; • non-infringement; • accuracy; • completeness; • availability; • uninterrupted operation; • error-free functionality. We do not warrant that the platform, its content, its AI features, or any results from using it will meet your expectations or requirements. 16. Limitation of Liability To the fullest extent permitted by law, Ops Check and its owners, operators, licensors, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to your use of or inability to use Ops Check. This includes, without limitation, damages for: • loss of study time; • failed tests; • lost opportunities; • inaccurate content; • exam results; • downtime; • data loss; • business interruption. To the fullest extent permitted by law, Ops Check's total cumulative liability for any claim arising out of or relating to the platform shall not exceed the greater of: • the amount you paid to Ops Check during the 12 months preceding the event giving rise to the claim; or • $50 USD if you paid nothing. 17. Termination Ops Check may suspend, restrict, or terminate your access at any time, with or without notice, for any reason, including suspected abuse, misuse, fraud, nonpayment, platform protection, or violation of this Agreement. You may stop using Ops Check at any time. Upon termination, the license granted to you under this Agreement ends immediately. 18. Inactive Account Deletion Ops Check is intended for active users. To reduce unnecessary storage of inactive accounts and associated user data, Ops Check may delete accounts that meet both of the following conditions: • the account has not had an active paid subscription or paid access entitlement for at least ninety (90) days; and • the account has had no recorded user activity for at least ninety (90) days. For purposes of this section, an "active paid subscription or paid access entitlement" may include an active Stripe subscription, Apple in-app purchase subscription, RevenueCat entitlement, or another paid access entitlement recognized by Ops Check. Trial access, bonus days, referral days, reactivation trial access, suspended pre-trial access, promotional access, or other free access periods do not count as an active paid subscription or paid access entitlement for purposes of inactive account deletion. Before deleting an eligible inactive account, Ops Check will attempt to send warning notices to the email address associated with the account. These notices may be sent approximately thirty (30) days, fourteen (14) days, seven (7) days, and one (1) day before the scheduled deletion date. You may cancel the scheduled deletion by logging into your account before the scheduled deletion date. Logging in before deletion confirms that the account is active and will stop the inactivity deletion process. If an account is deleted due to inactivity, associated account data may be permanently removed, including, but not limited to, profile information, study progress, question history, simulation records, classroom memberships, achievement data, AI DME activity, saved study data, and related usage data. Certain records may be retained if necessary for legal, security, payment processing, fraud prevention, tax, dispute resolution, backup, compliance, or operational reasons. Ops Check may exclude certain accounts from inactive account deletion, including administrator accounts, protected accounts, whitelisted accounts, accounts required for business operations, or accounts that must be retained for legal or compliance reasons. 19. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the applicable jurisdiction selected by Ops Check, without regard to conflict of law principles. 20. Changes to This Agreement Ops Check may revise or update this Agreement from time to time. The updated version will become effective when posted, unless otherwise stated. Your continued use of Ops Check after any update constitutes your acceptance of the revised Agreement. 21. Contact For support, legal inquiries, content concerns, or DME removal requests, contact Ops Check support by email. 22. Referral Program You may earn one free month (30 days) of Ops Check for each new user you refer, subject to the following: A referral qualifies when the person you referred creates a new account using your referral code and completes at least 20 minutes of study activity, which activates their free trial. Referrals that do not reach this threshold do not earn a reward. One reward is granted per referred person. Additional accounts created by the same person, including accounts using alternate, aliased, or forwarding email addresses, do not earn additional rewards. Self-referrals do not qualify. We may withhold or revoke rewards, and may suspend accounts, where we identify referral activity intended to generate rewards without genuine new users. We may limit the number of rewards a single user can earn in a given period. Free months are applied to your account as bonus days. If you have a paid subscription, billing is paused for the duration of the bonus and resumes automatically afterward. We may modify or end the referral program at any time. Changes apply to referrals made after the change takes effect. 23. Institutional and Bulk Licensing If you purchase Ops Check access for an institution, school, program, or other group ("Bulk Purchase"), the following additional terms apply. 1. Before completing a Bulk Purchase, you must confirm that you have read and agree to this Agreement in full. Completing a Bulk Purchase constitutes your agreement on behalf of yourself and, where applicable, the institution you represent. 2. Rate Lock. The per-seat rate and total price shown at the time of a Bulk Purchase are fixed for that purchase. If Ops Check later increases its subscription pricing, no additional fees will be charged for licenses already purchased, for the access term already paid for. 3. Refunds. Bulk Purchases are final and non-refundable once payment is completed, except where a refund is required by applicable law or where Ops Check fails to deliver the license or access purchased. In the event of a service issue, technical error, or platform malfunction affecting a Bulk Purchase, Ops Check may, at its sole discretion, grant account credit, extended access time, or another appropriate remedy in lieu of a monetary refund. 4. Publicity. By entering your institution's name in connection with a Bulk Purchase, you represent that you are authorized to do so, and you grant Ops Check permission to identify that institution as a user of Ops Check in marketing and promotional materials. This permission may be revoked at any time by written notice to us. 24. Content and Intellectual Property Protection All questions, explanations, study materials, simulations, and other content made available through Ops Check are the property of Ops Check or its licensors. You may not copy, scrape, reproduce, redistribute, extract, or use any portion of this content to build, train, or populate another product or service. We may suspend or terminate access for any account reasonably believed to be doing so. 25. Referral Program Participants Users who share a referral code or link do so as independent individuals acting on their own behalf. Sharing a referral code does not make you an ambassador, agent, representative, employee, or partner of Ops Check, and you have no authority to make any statement or commitment on behalf of Ops Check. 26. No Sale of User Data Ops Check does not sell your personal information to third parties, in any form. This is consistent with our Privacy Policy, which describes in full how we collect, use, and share information. ⸻ Ops Check Disclaimer Ops Check is an independent educational study platform intended to help users prepare for FAA-related written, oral, and practical evaluations. Ops Check is not affiliated with, endorsed by, sponsored by, or approved by the Federal Aviation Administration (FAA) or any other government agency. Educational Purpose Only Ops Check is intended solely for study and educational use. It is not official testing material, not official FAA guidance, and not a substitute for required training, approved technical data, maintenance manuals, current regulations, or instructor/examiner guidance. AI-Assisted Development and Content Artificial intelligence tools played a substantial role in assisting with the development of the Ops Check platform and in helping generate, organize, refine, or expand certain questions, prompts, explanations, and educational content. Because AI-assisted systems can produce mistakes, omissions, inaccuracies, outdated interpretations, and imperfect phrasing, Ops Check content may contain errors. Users are solely responsible for independently verifying important information against current official FAA references and applicable technical data. Source Material and Similarity Ops Check study materials are created and organized for educational purposes and are based on the operator's interpretation, summarization, and presentation of technical concepts drawn from publicly available FAA materials and other generally available aviation references where applicable. Any similarity between Ops Check multiple-choice questions, answer explanations, oral/practical prompts, or other study materials and any third-party publication, commercially available study product, or outside educational material is purely coincidental and/or arises from the fact that the same technical material, FAA concepts, terminology, and subject matter are being discussed. Similarity may also result from the limited number of ways certain aviation maintenance concepts can be accurately or naturally expressed. No Guarantee of Accuracy or Results While Ops Check aims to be useful and accurate, Ops Check does not guarantee that any content is complete, current, accurate, or error-free. Ops Check does not guarantee that use of the platform will result in passing any written exam, oral exam, practical exam, DME evaluation, or certification process. Studying, preparation, comprehension, retention, and testing performance are solely the responsibility of the individual user. Subscription Pricing Subscription pricing may change in the future at any time. Any such change will apply prospectively in accordance with applicable billing disclosures. DME Information Ops Check may display publicly available DME information for informational purposes. Any DME who wishes to have their information removed from the site may submit a request by email to Ops Check support, and Ops Check may remove or hide that information upon request. Not Operational Guidance Ops Check is not operational maintenance guidance and must not be used as the sole basis for performing aircraft maintenance, maintenance approval, or airworthiness decisions. Refunds Refunds are not automatic. If you believe there has been a billing error, technical issue, or if you are dissatisfied with Ops Check, you may request a refund by contacting Ops Check support by email. Any approved refund will be limited to the subscription payment for the current billing month in which the refund request is made. Ops Check does not provide partial refunds, prorated refunds, or refunds for prior billing periods. Ops Check reserves the right to review and approve or deny refund requests in its discretion, including in cases of suspected abuse, repeated refund requests, or misuse of the platform.
